The LAKEVILLE ZONING BOARD OF APPEALS, acting in accordance with MASS GENERAL LAWS CHAPTER 40A, as amended, will conduct a public hearing on Thursday, October 17, 2024, at 7:00 P.M. in the LAKEVILLE PUBLIC LIBRARY, 4 PRECINCT STREET, upon the petition of Tyler Horan. Ch. 40A §5 on THURSDAY, October 24, 2024 at 7:00 PM. at the Lakeville Police Station Meeting Room, 323 Bedford Street. The purpose of the public hearing is to provide interested parties with an opportunity to comment on proposed amendments to the Lakeville Town Code: Zoning By-Law as follows:
7:00 P.M. Public Hearing #1
This Article would amend the Lakeville Town Code: Zoning By-Laws §270-2.1, Terms defined, by adding to: FRONTAGE-That portion of a lot which is bounded by the street line or way, the sidelines and the minimum building setback line. The minimum required frontage must be contiguous and suitable for development of an access route or driveway to the building site.

This Article would amend the Lakeville Town Code: Zoning By-Laws §270-2.1, Terms defined, by adding a definition for Accessory Dwelling Unit (ADU) and establishing criteria;
To amend §270-6.7. Site Plan Review C. Applicability by adding: (7) New construction of a single Accessory Dwelling Unit (ADU)
To amend §270-7.4 Special Permits B by adding Accessory Dwelling Units (ADUs)
(a) SPGA: Board of Appeals
(b) Construction of more than one (1) ADU on a single lot shall require a special permit from the Board of Appeals, per guidance of the Acts of 2024, Chapter 150.
The balance of the Section will be renumbered accordingly.
7:00 P.M. Public Hearing #3
This Article would amend the Lakeville Town Code: Zoning By-Law §270-2.1, Terms defined, by amending the definition of Accessory Building or use to add the word structure;
To amend §270-6.3. as follows: Accessory buildings, structures, and uses;
To amend §270-6.3. and add the following text: C. No accessory building larger than allowed under §270-6.3C (1) shall be located on a lot used residentially unless a special permit is granted by the Zoning Board of Appeals. Where a special permit is sought under Law §270-7.4B for an accessory building larger than allowed on a lawfully pre-existing, non-conforming lot, the Zoning Board of Appeals shall additionally make a finding that the accessory building shall not be substantially more detrimental to the neighborhood than the existing non-conformity.
To add under §270-6.3. C the following: (1) A listing of the maximum aggregate of accessory building size by minimum lot area.
To amend §270-6.3. and add the following text: D. No accessory building larger than 1,500 square feet may be located closer than 40 feet from any property line on a lot used residentially.
To amend §270-7.4 by adding the following new section:
Accessory building larger than allowed under §270-6.3C (1)
(a) SPGA: Board of Appeals; all districts
(b) The Board of Appeals may impose certain restrictions, including but not limited to size, height, distance to property lines and/or number of buildings.
The balance of the Section will be renumbered accordingly.
